Neighborhood feud escalates in Wellfleet

WELLFLEET \emdash Three years ago Pond Avenue neighbors were arguing over a fence. This year, it's a proposed affordable housing development.
The dispute dates back several years to when Doris and Edward Zelinsky were refused a building permit for their 24,829-square-foot lot because it didn't meet the town's minimum size or frontage requirements. They then tried a legal maneuver they hoped would get them the additional land they needed.
They filed a request in court to force the sale of a 4,000-square-foot parcel held in common ownership by the neighborhood association. But their attempt to buy the lot failed when neighbors outbid them, paying $51,500.
The Zelinskys then erected a 6-foot-high stockade fence around their property, festooned with "Keep Out," "No Dumping" and "No Trespassing" in bright red letters.
This spring, the couple raised the ante by requesting a permit to build three condominium units on their lot under a state law known as Chapter 40B that allows a developer to bypass town zoning if at least 25 percent of the units in a housing complex qualify as "affordable" housing.
The town zoning board of appeals issues Chapter 40B permits and will start work on the Zelinsky application at their May 28 meeting.
Under state law, the town can deny it only if the health and safety of town residents is imperiled, the natural environment endangered, or the proposed site or building is seriously deficient.
Ronald Harper, who lives a street over from Pond Avenue, said the neighbors want the Zelinskys' property for conservation land and have offered to buy it. That, he said, would help reduce the amount of septic effluent reaching the nearby cove, help with a proposed walking trail around the cove, and re-open what he said is a footpath used by residents for 100 years that was closed off by the fence.
"The neighbors feel confident the zoning board of appeals will come to conclusion that benefit of maintaining the area for conservation purposes outweighs the benefit of a single condo of affordable ownership," said Ronald Harper, who lives a street over from Pond Avenue
But the town board of health has already passed the Zelinskys' septic plan that includes a nitrogen removal system to reduce its impact on water quality.
The Zelinskys, who live in New Haven, Conn., did not return a request for an interview yesterday.
Harper believes the couple would have been better off trying to work out a deal with the other co-owners of the 4,000-square-foot lot instead of forcing a sale through a court action.
"Had (Doris Zelinsky) been more forthright with other (property) owners, we wouldn't be having this conversation," he said.
